Athlete Foundry is a software-based service designed to help pre-college Student Athletes and Parents (herein “Customer”) successfully navigate the road to collegiate athletics to increase their odds of playing in college and increase their odds of success in life after sports, by purposefully developing the Student Athlete in a holistic way that better prepares them for life within and outside of athletics.


Athlete Foundry does NOT independently communicate on behalf of NOR represent at any time any individual Customer’s interests with prospective collegiate coaches, institutions, schools, teams, professional sports organizations or any other group or party attempting to market or profit from an individual Student Athlete’s athletic ability in any manner. Athlete Foundry does NOT independently have any direct contact with college coaches, institutions or teams on the specific subject of individual Athlete Foundry Customers.


Athlete Foundry does NOT independently share Customer contact, customer personal information, NOR customer-attributed data with any specific college coach, institution, school, team, professional sports organizations or any other group or party attempting to market or profit from an individual Student Athlete’s athletic ability in any manner.


Paid subscription for Athlete Foundry services is NOT based on placing a Student Athlete with any college institution, school, or team as a condition to receive a scholarship or salary.




MENTOR PROGRAM DISCLAIMER

Athlete Foundry is NOT a recruiter, we are an education technology company (“education” service per collegiate athletics guidelines); as such, each Collegiate Student Athlete (CSA) mentor is strictly prohibited from serving in any recruiting capacity.


All communications with Athlete Foundry and each mentorship session will be done virtually (phone & video calls) with QA checks; mentor sessions will be conducted via parental first contact.


Each selected CSA will get paid at least fair market value for all Athlete Foundry time, this includes orientation, mentor-mentee contact sessions, and pre- & post-session time as a 1099 contractor.


Mentor-mentee matching is confidentially made by Athlete Foundry, no names are ever shared a priori, with strictly zero considerations for athletic reputation, skills, or performance used during matching.


Mentors can’t use name, likeness, or pictures to promote nor sponsor any Athlete Foundry product or service, to include the mentorship program.




SCOUTING, RECRUITING, AND AGENT DISCLAIMER

Athlete Foundry is not an agent, scout, nor recruiter. Athlete Foundry does NOT provide any scouting or recruiting services.




COLLEGIATE COACH DISCLAIMER

Any active collegiate coach actively employed by a college or institution (herein “active collegiate coach”) engaged with Athlete Foundry will have NO access to any personal contact information NOR individual Customer data through their consulting relationship with Athlete Foundry. Active collegiate coaches affiliated with Athlete Foundry will NOT have any direct NOR indirect contact with any Customer through their relationships with Athlete Foundry. Athlete Foundry will NEVER speak on behalf of a Customer, NOR independently represent any Customer in dealings with an active collegiate coach, institution, team, professional sports organizations or any other group or party attempting to market or profit from an individual Student Athlete’s athletic ability in any manner.


Active collegiate coaches will NOT have access to any information NOR data related to other individual institutions, schools and teams that Athlete Foundry may gather in servicing its Student Athletes and Parents.


Active collegiate coaches which have a consultant relationship with Athlete Foundry will NOT under any circumstance use their affiliation with Athlete Foundry to market a specific college institution, college team, college coaching/ training service, professional sports organizations or any other group or party attempting to market or profit from an individual Student Athlete’s athletics ability in any manner.


This rule is designed to ensure Athlete Foundry is never used for the purposes of recruiting by any of our active collegiate coach that has a consulting relationship with Athlete Foundry and college-affiliated Athlete Foundry partners; plus intentionally create a thick and solid wall between Athlete Foundry-affiliated active collegiate coach consultants, and Athlete Foundry customers as part of Athlete Foundry company governance.




CUSTOMER DISCLAIMER

Athlete Foundry places sole responsibility and charge of the recruiting process back into the hands of the Student Athlete and Parent, while educating, informing, and empowering them to successfully navigate the road to collegiate athletics. Athlete Foundry does NOT offer any recruiting, scouting, nor agent services and will have NO independent contact with any college institution NOR individual in reference to an individual customer.


Athlete Foundry MUST obtain verifiable Customer approval on any use of a current pre-college Student Athlete or Parent’s likeness, and any former Student Athlete or Parent across any level. Any use of likeness shall be for testimonial purposes and consistent with fair use and permission of individuals’ images.


Athlete Foundry will never use the likeness of any Collegiate Student Athlete while she is actively considered a “Collegiate Student Athlete” at any level, as to not place her at any risk of forfeiting amateur status.




CUSTOMER AND COLLEIGIATE COACH INTERACTION DISCLAIMER

Athlete Foundry is not an agent, scout, nor recruiter, as such we do not independently contact collegiate coaches, institutions or teams on the specific subject of individual Athlete Foundry Customers. We permit our customers to share their data directly with the public at-large. In addition, collegiate coaches who have completed a simple registration and approved by the parent through the Athlete Foundry platform, are allowed to “follow” a student athlete. “Following” a student athlete provides the collegiate coach with access to athletic and academic historical data as granted by the customer, but does not open nor permit any active communication channel back to the customer.


We have implemented this at this time in order to present a strict compliance posture to both parties, particularly to provide the collegiate coach with peace of mind. Future platform upgrades will introduce appropriate and compliant communications methods from the collegiate coach to the customer, and will be based on strict sports-association and division compliance rules.




CHANGES

We may update this athletic governance compliance policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
